Supreme Court: Only the parties to a construction contract may invoke CIAC jurisdiction

In Stronghold Insurance Company, Inc. v. Spouses Stroem (G.R. No. 204689, January 21, 2015), the Philippine Supreme Court through Associate Justice Marvic V.F. Leonen once again reminds us that the jurisdiction of the Construction Industry Arbitration Committee (“CIAC”) may be invoked only by the parties to a construction contract containing an arbitration clause.

In an opinion issued on January 15, 2020 in G.R. No. 218924, Bureau of Internal Revenue v. First E-Bank Tower Condominium Corporation, penned by Associate Justice Lazaro-Javier, the Supreme Court (SC) held that association dues, membership fees, and other assessment/charges collected by condominium corporations are not subject to income tax, value-added tax (VAT), and withholding tax.
